I want to advise you that the proposed <br />newspaper publication included in the application will not satisfy <br />the requirements of CRS, 1973, 34-33-110(1){g) and Rule 2.07.3(2) <br />(b)(i); that the location and boundaries be identified by map or by <br />description so that the proposed operation is readily locatable <br />by local residents. A map or a simplified description (not the <br />legal description) would seem appropriate. 1Ve would be happ}' to <br />review any such additions to your newspaper notice prior to <br />publication if you arc uncertain as to what is required. <br />The Division has decided to request that all operators submit a <br />letter describing all materials which the operator wishes to be <br />considered confidential and the justification for the inclusion of <br />each item under the confidential restriction. <br />This request is being made of all operators and will be utilized <br />in the event that the propriety of maintaining the confidentiality <br />of said materials is questioned. If the legal brief being prepared <br />for you by Dave Sturges covers all the materials involved, his <br />letter will be most adequate. If, however, he is not discussing <br />the question with regard to insurance information, roof and floor <br />analyses, and any other information Dorchester Coal Company feels <br />it is necessary to protect, all these items most. be addressed. <br />This request does not affect the completeness finding but we are <br />urging all operators to supply this information as soon as possible. <br />
