<br />-4- <br />only one limited set of monuments is considered imprudent. Our eventual <br />findings should impose a stipulation specifically requiring the installation <br />of a second analogous set of subsidence monitoring monwnents at another agreed <br />location on Coal Ridge. <br />The applicant has amended the application to include a separate letter and <br />supporting communique from the U.S. Bureau of Mines indicating that a <br />subsidence research program would be instigated at the Coal Ridge mine, which <br />would provide supplemental subsidence monitoring facilities. In order to <br />assure that an adequate subsidence monitoring program is approved and <br />operational prior to any development within the coal seam, the Division <br />believes it appropriate to impose the following stipulation upon permit <br />approval. <br />STIPULATION: <br />IF THE U.S. BUREAU OF MINES AND STORM KING MINING HAVE NOT AGREED TO A <br />SUBSIDENCE MONITORING PROGRAM ACCEPTABLE TO THE DIVISION PRIOR TO COMPLETION <br />OF THE ROCK TUNNEL, THE DIVISION WILL REQUIRE STORM KING MINING TO AMEND ITS <br />CURRENT SUBSIDENCE MONITORING PROGRAM. FURTHER, NO MINING SHALL OCCUR WITHIN <br />THE COAL SEAM UNTIL STORM KING MINING HAS OBTAINED APPROVAL FROM THE DIVISION <br />FOR THE AMENDED SUBSIDENCE MONITORING PROGRAM. <br />It will be important to clearly present the results of the visual and survey <br />monitoring programs at the Coal Ridge No. 1 Mine. The amended application <br />presents no detail regarding the format of the semi-annual subsidence <br />monitoring reports. In the interest of facilitating complete and efficient <br />presentation of the accumulated subsidence monitoring data, the Division <br />believes it prudent to impose the following stipulation upon the permit <br />approval. <br />STIPULATION: <br />THE DIVISION DIRECTS STORM KING MINING TO PREPARE AND SUBMIT A FORMAT FOR THE <br />REQUIRED SEMI-ANNUAL SUBSIDENCE MONITORING REPORTS. THIS PROPOSED REPORT <br />FORMAT SHALL BE SUBMITTED FOR DIVISION REVIEW WITHIN SIX MONTHS FOLLOWING <br />ISSUANCE OF THE PERMIT. FURTHER, STORM KING SHALL HAVE OBTAINED APPROUAL OF <br />THE SUBSIDENCE REPORT FORMAT PRIOR TO ANY MINING WITHIN THE COAL SEAM. <br />Rule 2.06.4 Special Categories of Mining - Steep Slope Mining <br />Portions of the permit area qualify as steep slope mining areas, exhibiting <br />slope gradients in excess of 20°. Portions of these steep slope mining areas <br />will be subsided during the first five year permit period. Based upon the <br />information contained within the amended application, and assuming the <br />imposition of the above proposed stipulations, mining operations will comply <br />with the performance standards contained in Rule 4.27.3. Therefore, the <br />proposed operations will also conform with the requirements of Rule 2.06.4, as <br />well. The amended application fulfills the requirements of those sections of <br />our regulations concerning Steep Slope Mining. <br />
