Dept. of Natural Resources Re: Adequacy Response - Bear No. 1 and No Dear Dan: 2 Mine; Bear No. 3 Revision Pursuant to your letter of January 18, 1982 concerning the Bear Coal Company permit applications for the Bear No. 1, 2 and 3 operations, we have included responses in this letter which will address your comments and will clarify your additional concerns regarding the planned mining operation. The information contained herein is to be integrated into and considered a part of the permit applications. The Bear Coal Company is currently working with ARCO Coal Company to resolve their concerns about our mining plans. An agreement between the two companies regarding the legal rights-of-way at the Bear No. 3 Operation will hopefully be forthcoming shortly. The legal description of the area to be used far the Bear No. 3 surface facilities may be slightly revised to include some additional area (approximately 10 acres) as a result of the potential agreement with ARCO; the revised legal description will be submitted to the Colorado Mined Land Reclamation Division ("Division") under separate cover in the near future. This additional area will not change any of the mining or environmental control plans. We must again emphasize that Bear Coal Company is facing a real emergency. The immediate need for approval of mining plans at the Bear No. 3 Operation and reclamation plans far the Bear No. 1 and 2 Mines is imperative if we are to maintain present levels of production and employment. Unlike many major coal producers, the Bear Coal Company does not have vast amounts of coal reserves or large amounts of financial backing.
