Wathen <br />Reclamation Specialist <br />Division of Minerals and Geology <br />1313 Sherman St., Room 215 <br />Denver, CO 80203 <br />RE: Hayden Gulch Loadout Permit No. C-92-081 <br />Dear Mr. Wathen: <br /> <br />MAY 14 1993 <br />Division ~: wune~a~, « ~ro~oyy <br />I would like to take this opportunity to comment on a letter <br />sent to the Division by Mr. Ron Nereson dated May 3, 1993 <br />regarding the proposed decision on the above-referenced permit. <br />For the most part, I believe Mr. Nereson's opinions reference <br />operations conducted by the previous owner. Peabody's nighttime <br />operations since acquiring this facility have been limited to <br />approximately seven to ten days. Although future operations <br />could require utilizing second and third shifts, Peabody expects <br />to conduct most operational activities during daylight hours. <br />No trains have loaded coal while Peabody has operated the <br />loadout, although trains will temporarily block the County Road <br />on occasion once we begin coal shipments. Any inconvenienced <br />neighbors may opt to use the tie-across haul road as an <br />alternate route west to Hayden and east to Steamboat Springs on <br />those occasions when the road is blocked. <br />It is extremely doubtful that fugitive coal dust from Peabody's <br />operations are causing the problems alleged by Mr. Nereson. <br />Peabody is following the dust control plans outlined in the <br />approved Emission permits. Mr. Nereson's residence is <br />approximately one mile from any area of concentrated activity <br />and his property is situated at a higher elevation than the coal <br />processing area. Drainage from the coal processing area is <br />controlled, treated, and routed to Dry Creek. <br />Finally, please be advised that Midwest Railroad Contractors is <br />currently performing repairs at the crossing referenced in Mr. <br />Nereson's letter. Parts are understandably being stockpiled and <br />used at the site.
