Box AA <br />Hayden, Colorado 81639 <br />Re: Grassy Creek Mine <br />Our File No. C-039-81 <br />Dear Mr. Sherman: <br />The Division is approving an exemption from the sedimont pond requirement <br />of Rule 9.05.2 as provided by Rule 9.05.2(3)(a)and(b)(i), for portions <br />of the reclaimed pit No. 2, which presently drain into the collection <br />ditch along the northern perimeter of pit No. 2, east of the sediment pond. <br />The exemption will allow backfilling and revegetation of the collection ditch <br />so as to prevent diversion of runoff toward the backfilled slough area. <br />Final grading of the ditch should assure that runoff from the pit No. 2 <br />reclaimed area will be diverted away from the slough. Perennial vegetation <br />on the reclaimed area is well established and has effectivelu stabilized <br />the reclaimed surface. Backfilling and revegetation of the slough and the <br />collection ditch is to be completed as soon as possible this fall. <br />Sincerely, <br />S-1 <br />Dan T.
