HULTIN & SPAANSTRA <br />Mr. David Shelton <br />February 19, 1986 <br />Page 2 <br />expect that such a transaction would not require the approval of <br />your agency through the succession of operator's procedures. <br />However, previous discussions with your staff have revealed a <br />degree of uncertainty regarding the appropriate procedures to <br />utilize, particularly given the corporate name change and <br />replacement of surety. The parties to the transaction desire <br />that any regulatory procedures associated with replacing the <br />surety be accomplished as smoothly and quickly as possible. For <br />this reason, we have enclosed with this letter a completed <br />Succession of Operators form, a revised application form (five <br />copies), a revised Identification of Interests section to the <br />pending Fruita Project permit application (five copies) and a <br />proposed publication we intend to run in the Grand Junction <br />Sentinel pursuant to Rule 2.08.6(3)(a). We believe that this <br />represents all of the information necessary for your staff to <br />proceed with the review and approval of the permit transfer. We <br />understand that the final approval and release of the existing <br />letter of credit cannot occur until American Shield submits a <br />replacement form of financial surety. We currently anticipate <br />making that submission on or about February 28, 1986. We will <br />appreciate your agency's prompt review and efficient processing <br />of these documents. <br />American Shield intends to be an active participant in the <br />coal industry. In this light we will be diligently pursuing <br />approval of the permit applications for the Fruita Project which <br />are currently on file with your office. We expect to meet with <br />your staff in the near future to confirm a review schedule.
