SHELTON, Director <br />April 24, 1987 <br />Mr. Joe Carpio <br />La Plata Coal Corporation <br />3701 County Road 120 <br />Hesperus, Colorado 81326 <br />RE: La Plata #1 -Notice of Intent X-87-201-00 <br />Dear Mr. Carpio: <br />As noted in our April 21, 1987 letter, we were in the process of reviewing <br />your notice-of-intent application, including developing reclamation costs. We <br />have completed our review and have identified a number of concerns as <br />specifically addressed below. <br />Prior to addressing the specific concerns, we would like to address two <br />general points. First, as part of the notice-of-intent you submitted a copy <br />of your revised permit application for coal mining and reclamation (File <br />C-87-072). While we did mention in our March 31, 1987 letter that portions of <br />this application could be utilized, we did not envision you would submit the <br />entire document. As to be addressed below, we believe some of this document <br />is appropriate for use in the notice of intent, but not all of the mining <br />application is applicable. Therefore, some clarification is required. <br />Second, insufficient information has been submitted with this notice-of-intent <br />to substantiate your request to install the four concrete sorting/storage <br />bins, the screening plant, and the overland conveyor system. The Division has <br />determined that these items are not an integral and necessary component for <br />your notice-of-intent but would rather be construed as mine development <br />necessitating a coal mining and reclamation permit. The Division will <br />reconsider this conclusion if you can demonstrate that your proposed <br />exploration activities can not effectively take place without these <br />structures. The Division realizes that a portion of this discussion is no <br />longer valid since you have already constructed the majority of the four <br />sorting/storage bins. Because these structures are existing, we have <br />determined that these bins may be used as is and have developed reclamation <br />casts accordingly.
