Dept. of P.!ate'2~ ~'~J~'!I~e~ 1313 Sherman Street Denver, Colorado 80203 Re: Pit 3/Surety Release under 1976 Mined Land Reclamation Act Dear Dave: AREA CODE 303 292-9450 Accompanying this letter is a copy of correspondence and an accompanying map to Fred Banta by which Energy Fuels makes application for the release of certain tracts of reclaimed lands at Pit 3 from its outstanding surety bond. As you can see, this application is being submitted pursuant to the surety release provisions of the 1976 Act, due to the fact that backfilling, grading and initial seeding had been completed on all of these tracts prior to the promulgation of the OSM Interim Regulations. Indeed, many of the tracts had been seeded before the reenact- ment of the Federal Surface Mining Act. We are submitting this application now in an effort to allow for processing and surety release prior to the approval of the new state program, thereby hopefully reducing procedural confusion.
