Introduction <br />The Division has received an application for a permit renewal to conduct <br />surface mining and reclamation operations at the Carbon Junction Mine. The <br />mine is located in La Plata County, Colorado. The permit area encompasses <br />approximately 530 acres within Section 4, T34N, R9W; Section 33, T34 1/2 N, <br />R9W; and Section 33, T35N, R9W, New Mexico P.M. <br />This document is the decision package prepared by the Colorado Mined Land <br />Reclamation Division (the Division) for the Carbon Junction Mine. This <br />document includes: 1) the recommendation that the Mined Land Reclamation <br />Board (the Board) issue a decision to deny the permit renewal application; <br />2) a summary which includes a history of the review of the permit application, <br />a description of the environment affected by the operation and a description <br />of the mining and reclamation plan; and 3) the written findings the Division <br />has made as required by the Colorado Surface Coal Mining Reclamation Act. <br />Detailed information concerning the required findings of compliance can be <br />found in the Regulations of the Colorado Mined Land Reclamation Board for Coal <br />Mining. <br />Recommendation to the Mined Land Reclamation Board <br />The Colorado Mined Land Reclamation Division is recommending denial of an <br />application for renewal of Permit C-82-054. <br />The application was submitted by Pueblo Coal Incorporated, for the Carbon <br />Junction Mine. This recommendation is based on a finding that the operation <br />is not in compliance with all requirements of the Colorado State Program as <br />found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 <br />et seg., and the regulations promulgated pursuant to the Act. Specific <br />reasons for this recommendation to deny are detailed in the Findings section <br />of this document. Requests for a formal hearing may be made within thirty <br />(30) days of the first publication of the issuance of this proposed decision. <br />A formal hearing before the Mined Land Reclamation Board has been scheduled <br />for December 13. 1989. <br />Summary <br />History of the review process, description of the environment and description <br />of the operations and reclamation plan. <br />History of the Review Process <br />Pueblo Coal Ines (PCI) Carbon Junction Mine is a surface coal operation <br />located approximately 2 1/2 miles southeast of Durango, Colorado The mine is <br />currently inactive and has been in temporary cessation since April, 1986. <br />
