1 <br />1 <br />1 <br />1 <br />1 <br />1 <br />1 <br />1 <br /> <br /> <br />RESPONSE TO SUBSTANTIVE DIFFERENCES BETWEEN COLORADO AND FEDERAL <br />REGULATORY PROGRAMS. <br />30 C.F.R. §779.17 ALTERNATIVE WATER SUPPLY INFORMATION <br />The application shall identify the extent to <br />which the proposed surface mining activities may <br />proximately result in contamination, diminution, <br />or interruption of an underground or surface <br />source of water within the proposed mine plan or <br />adjacent areas for domestic, agricultural, indus- <br />trial, or other legitimate use. If contamination, <br />diminution, or interruption may result, then the <br />description shall identify the alternative sources <br />of water supply that could be developed to replace <br />the existing sources. <br />S.R. 2.04.7(3 <br />(3) Alternative Water Supply Information. The <br />application shall identify the extent to which the <br />proposed surface coal mining operations may proxi- <br />mately result in contamination, diminution, or in- <br />terruption of an underground or surface source of <br />water within the proposed permit area and adjacent <br />areas for domestic, agricultural, industrial, fish <br />and wildlife, or other legitimate use. If contam- <br />ination, diminution, or interruption may result, <br />then the description shall identify the alterna- <br />tive sources of water supply or sources of augmen- <br />tation water that could be developed to replace <br />the existing sources. (See Article 83 and 92 of <br />Title 73 of the 1973 Colorado Revised Statutes). <br />RESPONSE TO S.R. 2.04.7(3) <br />Surface water features within Colorado Yampa <br />Mines No. 1 and 2 and Eckman Park, including those <br />features which are sources of water for fish and <br />wildlife, are described in the application for <br />Permit No. 79-177 under Section 779.16 (all Sec- <br />tion references are to the application for Permit <br />-4- <br />
