Section 816.116 REVEGETATION: STANDARDS FOR SUCCESS <br /> (a) Success of revegetation shall be measur- <br /> ed by techniques approved by the regulatory autho- <br /> rity after consultation with appropriate State and <br /> Federal agencies. Comparison of ground cover and <br />' productivity may be made on the basis of reference <br /> areas or through the use of technical guidance <br /> procedures published by USDA or USDI for assessing <br />' ground cover and productivity. Management of the <br /> reference area, if applicable, shall be comparable <br /> to that which is required for the approved post- <br />' mining land use of the permit area. <br /> (b)(1) Ground cover and productivity of liv- <br /> ing plants on the revegetated area within the per- <br /> mit area shall be equal to the ground cover and <br /> productivity of living plants on the approved re- <br /> ference area or to the standards in other techni- <br /> cal guides approved by the Director for use in the <br /> regulatory program. <br />' S.R. 4.15.7(3)(b) <br />(b) The permittee shall demonstrate statistical- <br />, ly, to the satisfaction of the Division, that each <br />proposed reference area is comparable to its equi- <br />valent area to be disturbed in terms of herbaceous <br />cover and productivity and other applicable para- <br />' meters with the exception that, where cropland is <br />the approved postmining land use, the permittee <br />need only demonstrate that the proposed reference <br />' area is comparable to the equivalent area to be <br />disturbed in terms of crop production. <br />RESPONSE TO S.R. 4.15.7(3)(b) <br /> Rule 4.15.7(3)(b) requires that the permittee <br />' demonstrate statisti <br />ll <br />t <br />th a <br />d f <br />r- <br /> y <br />ca <br />a propose re <br />e <br />' ence area is comparable to its equivalent area to <br /> be disturbed by mining.
