The permit will <br />need to be revised with a minor revision to update the permit with the stockpile volume <br />data. <br />Vegetation Information -Rule 2.04.10 <br />24. NP provided an updated vegetation map, Map 3, prepazed in accordance with Rule 2.10, <br />which delineates the plant communities with the area to be affected by surface activities <br />for underground mines. The map is acceptable. <br />25. NP will be collecting data from the area to be disturbed in June 2007. A copy of the <br />report will be provided when the vegetation survey is completed. <br />26. This section will be addressed with the vegetation survey. <br />Rule 2.04.10(5) and Rule 2.04.11(4) <br />27. The Colorado Division of Wildlife provided an evaluation of the possible impacts to the <br />threatened and endangered species in a letter dated January 5, 2007. According to DOW <br />they do not believe the actions proposed in the permit application will have an impact on <br />the Arkansas Darter, Bald Eagle, Black-footed Ferret, Canada Lynx or the Mexican <br />Spotted Owl. The letter is included in Exhibit T of the application. Response accepted. <br />Rule 4.15 - Revegetation <br />28. NP has provided an acceptable vegetation monitoring plan. <br />29. This question will be addressed with the baseline vegetation survey and submitted later. <br />30. NP removed references to augmented seeding. Response accepted. <br />31. The revised proposed permanent seed mix in Table 2.05.4-2 is acceptable. NP has <br />reduced the proposed mulch rate to 2000 pounds per acre as suggested by the Division. <br />Response accepted. <br />
