X8]6 Ror Romer Governor ~~~ich~el B. Long Division Director The Division received your letter commenting on the permitting of the HG Loadout on May 5, 1993. It is not clear from your letter if you are formally requesting a hearing before the Mined Land Reclamation Board (no hearing on this matter will be held unless someone formally requests one). I have not been able to reach you by telephone since I received your letter. Please let the Division know in writing or by telephone, as soon as possible, if you are requesting such a hearing. Without a request for a formal hearing before the Mined Land Reclamation Board, the Division is scheduled to approve Hayden Gulch Terminal, Ines (HGTI) permit for the HG Loadout on May 23, 1993. If you, or someone else, requests to appear before the Mined Land Reclamation Hoard concerning issuance of HGTI's permit, the permit will not be issued until such an appearance can be scheduled. The Colorado Division of Minerals and Geology regulates environmental compliance and reclamation at coal mines in the State. The Division does not make land use decisions except as our regulations are affected. Your letter of May 3, 1993 listed four separate concerns that you have with the permitting of the HG Loadout to HGTI. I would like to talk to you about these concerns. In your clarification letter to the Division, please leave a telephone number where you can be reached during business hours.
