Long <br />Division Director <br />The Division received your letter commenting on the permitting of <br />the HG Loadout on May 5, 1993. It is not clear from your letter if <br />you are formally requesting a hearing before the Mined Land <br />Reclamation Board (no hearing on this matter will be held unless <br />someone formally requests one). I have not been able to reach you <br />by telephone since I received your letter. Please let the Division <br />know in writing or by telephone, as soon as possible, if you are <br />requesting such a hearing. <br />Without a request for a formal hearing before the Mined Land <br />Reclamation Board, the Division is scheduled to approve Hayden <br />Gulch Terminal, Ines (HGTI) permit for the HG Loadout on May 23, <br />1993. If you, or someone else, requests to appear before the Mined <br />Land Reclamation Hoard concerning issuance of HGTI's permit, the <br />permit will not be issued until such an appearance can be <br />scheduled. <br />The Colorado Division of Minerals and Geology regulates <br />environmental compliance and reclamation at coal mines in the <br />State. The Division does not make land use decisions except as our <br />regulations are affected. Your letter of May 3, 1993 listed four <br />separate concerns that you have with the permitting of the HG <br />Loadout to HGTI. I would like to talk to you about these concerns. <br />In your clarification letter to the Division, please leave a <br />telephone number where you can be reached during business hours. <br />If you call the Division, please ask to speak to either myself, or <br />in my absence, Larry Routten. <br />
