DRAFT <br />XVII. Backfillinq and Cradinq (2.05.3(6), 2.05.3(9), 2.05.9(2)(a), 2.05.9(2 <br />The mine bench material will provide the material necessary to backfi.ll the mine <br />bench and haul road. Due to the steep slope nature and the tendency towards <br />instability a variance of the approximate original contour restoration requirements <br />of Rule 4.14.1(2)(a) is appropriate under the provisions of Rule 9.27.4. Blue <br />Ribbon Coal Company has committed to providing an appropriate geotechnical analysis <br />to demonstrate compliance with Rule 4.27.4(1). All other provisions have been <br />satisfactorily addressed within the application. The description of the reclama- <br />tion plan including backfilling and grading begins on page 108 of the permit <br />application. A plan view of the post-mining topography and correlated cross- <br />sections are presented on Exhibits F and B, respectively. <br />Underground development waste generated at the Blue Ribbon mine will be hauled to <br />the Red Canyon mine's appz'oved waste disposal pile site. Both mines are currently <br />owned by Western Associates, Inc. If this corporate relationship cvere to be <br />modified in the future, the Blue Ribbon mine will be required to obtair, approval <br />for an alternative cvaste disposal facility or to bacF:stow the material tai thin the <br />underground workings. The application is in compliance with the requirements of <br />this section of the regulations. <br />XVIII. Coal Processing Waste and Non-Coal Processing 47aste (2.05.3(8), 2.05.9(2)(f), <br />4.10, 4.11) <br />The only coal processing done on the Blue Ribbon mine site is screening of coal <br />for size separation. No coal processing waste is produced during this process. <br />Therefore, the application is in compliance with the requirements of this section <br />of the regulations. <br />XXII. Sealing of Drilled Holes and Underground Openings (2.06.4(2)(g), 4.07) <br />(NO CHANGES NECESSARY) <br />XXIII. Subsidence (2.05.6(6), 4.20 <br />There are no rener~~able resource lands or structures in the permit area. Therefore, <br />no further consideration is required by those sections of the permit regulations <br />which relate to subsidence control. The applicant has satisfied all statutory <br />obligations regarding subsidence. <br />XXI V. Special Categories of Pli ping (2.06, 4.22, 4.23, 4.26, 4.27, 4.28, 4.29) <br />The applicant has indicated an intention to request a variance from approximate <br />original contour restoration requirements for steep slope mining, pursuant to <br />Rule 2.06.5. The Division agrees that the portal bench area constitutes a steep <br />slope mining situation. However, the applicant has failed to properly demonstrate <br />compliance with the requirements of Rule 2.06.5(2). In order to demonstrate <br />compliance with these regulatory requirements, the Division imposes the following <br />stipulation. <br />
