name and address of the purchaser of the property to be mined (Rule <br />2.03.4(1)(d)), the name and address of the operator (Rule 2.03.4(1)(e)), <br />the name and address of the resident agent (Rule 2.03.4(1)(f)), and the <br />identification of business information pertaining to La Plata Coal (Rule <br />2.03.4(2)) needs to be submitted. <br />3. Page 2.03-8 of the application mentions that La Plata". holds interest <br />in lands, options, or pending bids or an interest for lands which are <br />contiguous to the area to be covered by this permit". La Plata Coal <br />needs to specify the interests that are held. If appropriate, La Plata <br />Coal may want to reference a map when discussing these interests. <br />4. One of the findings the Division must make pertains to the past <br />compliance of La Plata Coal and of the five people owning interests in La <br />Plata Coal. No information is presented in the application to allow the <br />Division to make this finding. The regulations under Rule 2.03.5 <br />addresses the information that La Plata Coal needs to submit. <br />5. Another finding the Division must make pertains to La Plata Coal's legal <br />right to enter and begin mining activities in the proposed permit area. <br />We have not received sufficient information to be able to make this <br />finding. La Plata Coal needs to submit copies of the entire lease rather <br />than the portions now in Exhibit 1. Also, La Plata Coal should submit <br />the statements and descriptions as outlined under Rule 2.03.6. <br />6. The Certificate of Insurance (Exhibit 2) does not provide sufficient <br />minimum coverage as required (Rule 2.03.9(1)). La Plata Coal needs to <br />update this policy to reflect the minimum coverage requirements for both <br />bodily injury (5300,000 for each occurrehce and 5500,000 aggregate) and <br />property damage (5300,00 for each occurrence and 5500,000 aggregate). <br />7. Upon receipt, La Plata Coal needs to submit for inclusion into Exhibit 3 <br />the permits or licenses received from the various other agencies listed <br />on pages 2.03-10 and 2.03-11. <br />8, Page 2.03-11 of the application provides a discussion pertaining to a <br />"Special Use Permit" from La Plata County. It is our understanding that <br />the issuance of such a county permit is independent rather than <br />contingent upon issuance of a permit from this office.
