Box 1941 Durango, Colorado 81301 Re: La Plata #1 Mine - Preliminary Adequacy Review - File No. C-87-072 Dear Mr. Carpio: The Division has completed its Preliminary Adequacy Review (PAR) of the permit application you submitted. During this review, the Division identified a number of concerns as outlined in the attached document. For ease of reference, we have arranged the concerns by major topic as presented in the application. While the attached document presents specific concerns, we would like to address some general points. First, there are a number of contradictions throughout the application. An example of this is the point we discussed during our meeting of March 10th pertaining to the extent of backfilling at the mine. We suggest that La Plata Coal review the application and delete the inconsistencies. Second, we are uncertain about proposed annual coal production. During previous conversations with you and as stated in a February 1, 1987 Durango Herald article, an annual production of 36,000 tons or 3,000 tons per m~~was proposed. The application projects production of 50,000 tons annually (or about 4,200 tons monthly). Since an accurate determination of annual coal production is needed, please confirm the correct proposed production rate. If production levels are different than the amount stated in the application, updates to the text and map will be necessary. Third, we are aware that you used the previously submitted Sunbelt Mining permit application as the basis for your application. Because of your modification of this previous permit application, several organizational problems have occurred. An example of this is in Section 2.05 where the discussion pertaining to underground development is interrupted by a brief discussion on access roads. We suggest that La Plata Coal review the application and correct these organizational problems. Once you have familiarized yourself with the attached adequacy review document, I would suggest a meeting with the Division to clarify any questions you have.
