In order to insure the safety of the public, the applicant should <br />commit~to the examination of the portal bench by an appropriately <br />qualified professional a[ the time of backfilling and nrading. <br />Any areas which are determined to represent signil:icant stability <br />problems should be treated in order to minimize existing <br />hazards following. reclamation. <br />2.06.8(3) Alluvial Valley Floors <br />In the permit application alluvial valley floors were identified <br />along both Trout Creek and along Middle Creek. Sufficient back- <br />ground information was provided on the Trout Lreek AVF except a <br />confirmation is needed that the post-mining agricultural utility <br />and level of productivity would equal or exceed the premining situation <br />in accordance with Rule 4.24. <br />2. As discussed in other sections of this letter insufficient information <br />was provided to evaluate the impact of mining to Middle Creek. <br />Depending upon the outcome of the probable hydrologic consequences <br />of mining evaluation requested in section 2.04.7, additional information <br />may be required concerning productivity, agricultural significance and <br />essential hydrologic functions of the Middle Creek A.V.F. <br />3. In order for the Division [o identify the geographical extent of <br />lands eligible for [he grandfathering exemption (Rule 2.06.8(5)(a) <br />(i)(C)), the applicant should delineate the actual extent of the <br />mine workings on August 3, 1977. and provide all available information <br />identifying adjacent lands for which there existed substantial <br />demonstrable financial (contracts) or regulatory commitment <br />(permits) to mine in the future.
