The information set forth in this document was taken from <br />the public files kept at the Mined Land Reclamation Division (the Division) <br />office. <br />* On May 14, 1984 the Division notified Mount Harris Coal Company that a <br />permit was necessary to operate the coal loadout facility <br />* On April 25, 1985, the MLRB (the Board> issued a Findings of Fact, <br />Conclusions of Law, and Declaratory Order (see attachment A). The <br />Declaratory Order required that a permit application be submitted by Mt. <br />Harris Coal Co. <br />* On June 19, 1985 Mt. Harris Coal Company indicated its intent to file an <br />application for a permit for its loadout facilities. The permit was <br />received by the Division on October 17, 1985. <br />* On June 6, 1986 the Division issued a Proposed Decision and Findings of <br />Compliance for the Mt. Harris Coal Company. The decl5ion was to approve <br />the permit for reclamation activities only. It was determined that <br />$10,000 reclamation bond was necessary. Two conditions and four <br />stipulations were required to be a part of the issued permit (see <br />attachment B). <br />* On June 24, 1986 Mount Harris withdrew its application for a reclamation <br />only permit. <br />* On August 22, 1986 and September 17, 1986 Mount Harris made some written <br />commitments to reclaim the property. <br />
