Location: Approximately 5 miles east of Hayden, Colorado on U.S. 40.
The following is a brief explanation of the history of the Mount Harris Coal
Loadout Facility. The information set forth in this document was taken from
the public files kept at the Mined Land Reclamation Division (the Division)
office.
* On May 14, 1984 the Division notified Mount Harris Coal Company that a
permit was necessary to operate the coal loadout facility
* On April 25, 1985, the MLRB (the Board> issued a Findings of Fact,
Conclusions of Law, and Declaratory Order (see attachment A). The
Declaratory Order required that a permit application be submitted by Mt.
Harris Coal Co.
* On June 19, 1985 Mt. Harris Coal Company indicated its intent to file an
application for a permit for its loadout facilities. The permit was
received by the Division on October 17, 1985.
* On June 6, 1986 the Division issued a Proposed Decision and Findings of
Compliance for the Mt. Harris Coal Company. The decl5ion was to approve
the permit for reclamation activities only. It was determined that
$10,000 reclamation bond was necessary. Two conditions and four
stipulations were required to be a part of the issued permit (see
attachment B).
* On June 24, 1986 Mount Harris withdrew its application for a reclamation
only permit.
* On August 22, 1986 and September 17, 1986 Mount Harris made some written
commitments to reclaim the property.
