<br />• <br />(24) <br />(e) In reclamation and rehabilitation, the lessee, s11a111, apply <br />only enough water to meet the consumptive use of the Veg~taCion. <br />This stipulation is discussed in subsection 4.4.2.1 Water <br />to Section 414 Itecl.amation Plan. As the above revegetation section <br />points out, a diverse mixture of native species is being used to <br />minimize irrigation needs. Some irrigation will probably pe <br />reyuircd after planting during dry periods until the revegetation <br />process takes hold <br />(f) If subsidence occurs such that bare soil cuts areexposed, <br />the lessee shall. grade and revegetate as necessary to reduce erosiop <br />and control soil slumping. <br />All subsidence which involves the exposure of bare soil cuts <br />will be graded and regegetated pursuant to Section 4.4 Recia~nation <br />of the mining plan. 'the potential for subsidence problems'~is <br />discussed in Subsection 3.2.3.3 of the mining plan and above in <br />our comments to EPA. <br />(g) Construction activities (heavy equipment, helicopters, <br />blasting, etc.) will be prohibited within 1,000 feet of any golden <br />eagle nest during the nesting period (March 1 to July 1). <br />Subsection 4.5.1.5 (b) of the mining plan (page 58) contains <br />CWI's operations committment to prohibit construction activities <br />within 1,006 feet of the Golden Eagle nest during the Marci 1 to <br />July 1 nesting period. <br />(h) Cutting of snags is prohibited except those within, the <br />actual disturbed area required for construction. <br />CWI notes and will comply with the prohibition on thecutting <br />of snags except within the actual disturbed area required for <br />construction. <br />(i) The lessee shall be required to install, maintain and use <br />all necessary equipment to effectively abate dust created by truck <br />transport between mine mouth and rail loading facilities.Fugitive <br />dust must be controlled cahether caused by material being transported, <br />or by truck and other vehicular movement over the access roads. <br />CWI'soperational plan to control fugitive dust from t <br />is contained in subsection 4.5.1.2 of the mining plan (page <br />', t, <br />Ir '~I i <br />icks <br />31). <br />i~~~.
