Richard D. Lamm
Governor
DEPARTMENT OFNATURALRESOURCES
David H. Getches, Executive Director
MINED LAND RECLAMATION DIVISION
DAVID C. SHELTDN, Director
DATE: January 10, 1985
T0: Jim Herron
FROM: Michael Savage ~ a..~ l~
RE: Findings for Coal Ridge No. 1 Mine C-065-84
I have modified my original findings to reflect the information Storm King
submitted after our meeting of December 11, 1984, and after rereviewing
pertinent references.
Vegetation - Rules 2.04.10, 2.05.4(2)(e), and 4.15
The Division reviewed the application for compliance with Rules and
Regulations. Vegetation baseline information is contained on pages 3-124
through 3-142 of Volume I, Appendices 3.6-1 in Volume II, and 3.6-2 and 3.6-3
in Volume VI; the revegetation plan is contained on pages 4-68 and 69, and
4-71 through 74 in Volume I.
The Coal Ridge No. 1 Mine proposes to disturb significance acreage in three
vegetation communities and a small area of a fourth conrtnunity during the life
of mine. The applicant proposes to disturb 104 acres of sagebrush community,
113 acres of pinon-juniper vegetation type, 30 acres of irrigated hayland, and
9 acres of mountain shrub. The applicant had vegetation baseline studies of
varying scope and location undertaken by three different consultants during
different years (1981, 1983, 1983).
At this time, the applicant proposes to disturb acreage contained in the
sagebrush community only. Therefore, the Division has reviewed the
application with respect to the proposed phase I disturbance. Findings are
made with respect to the sagebrush community, and proposed disturbance in
phase I only.
After much discussion, it was determined that the applicant has adequately
sampled cover, production, woody plant density, and diversity for the
sagebrush community affected and reference areas.
In reviewing the revegetation plan several areas were not addressed
sufficiently to allow the Division to make a finding of compliance. For this
reason the following stipulation is required:
Stipulation 2
THE PERMITTEE SHALL REVISE THE PERMIT WITHIN A 120 DAYS OF APPROVAL TO
REFLECT THE FOLLOWING REQUIREMENTS. IN THE CASE OF REQUIRED CHANGES,
BELOW, THE PERMITTEE MUST HAVE WRITTEN APPROVAL OF THE DIVISION PRIOR
TO THE STIPULATION BEING SATISFIED.
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
