Dept. vi Natural Resources <br />Re: GEX Colorado, Inc., - Cameo and Roadside D9ines <br />Dear Rick: <br />As we discussed, I enclose a copy of an April 7, 1981 letter <br />from Donald A. Crane, Esq., Regional Director of the United States <br />Department of the Interior, Office of Surface Mining. It per- <br />tains to GEX's applications currently under review on the Cameo <br />and Roadside mines. Dir. Crane observes that GEX has claimed con- <br />fidential treatment on a considerable portion of the material pro- <br />vided in connection with such applications. He adds that the GEX <br />claim appears to go beyond the scope of confidentiality provided <br />in the Surface Alining Control and Reclamation Act, which of course <br />is mirrored in the Colorado Surface Coal D9ining Reclamation Act. <br />Mr. Crane has requested that we forward to you his determination <br />that such information cannot be considered confidential. He also <br />asks that GEX consent to "declassify" such information. <br />Perhaps someone at GEX will meet with Keith Kirk, who is men- <br />tioned in Dlr.
