Dear Mike:
This will confirm our telephone conversation regarding the
statis of land use approval for the subject coal operation
located on U. S. Hwy 160 west of Durango. It is the position
of the county that this operation does have land use approval by virtue
of the previous permit issued to Arness bic Griffin Coal Company
in 1978. It is further the county's position that this permit
remain viable, given the arrangement between Arness hic Griffin
Coal Company and Peerless Resources, Inc., which will be the operator
of the mining activity.
In summry, no additional county land use review will be necessary
for Peerless Resources, Inc. to operate this mine.
