The DSFS identified a need for monitoring of water sources (springs and stock <br />ponds, etc) above areas to be retceat mined during the grazing season. The <br />monitoring would be required monthly unless the District Ranger determines a <br />different frequency is necessary. This commitment was made in the permit <br />application and therefore, a special condition was not needed in the State <br />permit or mining plan approval. <br />Additional mitigative stipulations are included in the Colorado MLRD renewed <br />permit. <br />1~+o special conditions of the existing mining plan approval are no longer <br />necessary. Special Condition 5 required the addition of the United States of <br />America to the bond as a co~bligee. This has been done. Special Condition 6 <br />stated that the_mining plan approval does not affect the outcome of the (then <br />current) challenge to the Federal permit before the Interior Board of Lands <br />Appeal (IBLA). A decision on the merits of the case was issued by the IBLA on <br />September 27, 1985, and on the issue of relief on November 18, 1986.
