If this is incorrect, please state why. <br />Please state whether Bruce Addington "owns and/or controls", or with the period from <br />12/23/91 to 12/23/96 "owned and/or controlled", any surface coal mining and/or <br />reclamation operations in the US (Section 2.03.4(3)(d)) other than those listed above. <br />21. The applicant's response is inadequate. Section 2.03.4(4)(a) requires that each surface <br />coal mining operation currently "owned and/or controlled" by Bruce Addington be <br />identified by operation name, as well as State permit number. Please revise the <br />application to include this information. <br />Section 2.03.4(4)(6) requires a description of Bruce Addington's ownership or control <br />relationship (including percentage of ownership and location in organizational structure) <br />to each operation (not company) in which he is a current owner or controller. While <br />information provided in the application indicates that Addington Mining, Inc., Mining <br />Technologies, Inc. and Addwest Mining, Inc. were merged into Addington Enterprises, <br />Inc., and that Bruce Addington resigned from the Board of Directors of Addington <br />Enterprises, Inc., it is uncleaz what Bruce Addington's current ownership or control <br />relationship is to the other operations listed in the application. Please revise the <br />application to include this information. <br />23. The applicant's response is adequate. However, review of page 93 of permit application <br />Section 1 indicates that there may be a link between Bruce Addington and a bond <br />forfeiture (Century, Inc.). Please describe Bruce Addington's past and/or present <br />relationship with Century, Inc. <br />24. The applicant's response is inadequate. The response indicates the legal description for <br />the permit area is contained in Exhibit 2. Page 11 of Exhibit 2 indicates the permit azea <br />will be 17,861.84 acres. However, page 2 of the "Application Form for a Permit to <br />Conduct Coal Mining in Colorado" indicates the permit area will be 17,895 acres. Please <br />address this apparent discrepancy. <br />25. The applicant's response was provided via an April 3, 1997 letter from Robert A Bassett. <br />In this letter Mr. Bassett has indicated that language allowing the construction of rail road <br />spurs is included in "Paragraph ].g" of the Coal Lease Agreement. This section of the <br />Coal Lease Agreement was not provided in Exhibit 2. Please provide this. <br />Rule 2.04.3 Site Descriutioo and Land Use Information <br />Under this section, all responses were found adequate except as listed below. <br />30. Lorencito Coal Company revised page 2.04-2 to reflect land use capabilities and <br />productivity. Lorencito Coal Company states that the irrigated hayland within the permit <br />area generally produces 1 ton of hay per acre per cutting. This productivity level assumes <br />
