Mike Long <br />Page 8 <br />6. Due to the change in the post mining land use <br />baseline information which describes the pinyon <br />community is not needed. This was agreed upon <br />during our discussion on the above referenced <br />date. <br />Transect lines which depict the areas where <br />vegetation sampling occured will be added to the <br />vegetation map. The riparian community located <br />along Stollsteimer Creek will also be added to the <br />same map. <br />Refer to the attachment provided herewith for a <br />discussion of the concerns provided in this part <br />of the P.A.R. <br />9. As we discussed in your office on the above <br />referenced date, vegetation sampling was conducted <br />based upon guidance received from the Division as <br />well as the requirements defined in the regulations. <br />An attachment hereto is provided which presents a <br />response to this concern. <br />10. The previously developed vegetation map referenced <br />in the permit is a portion of the existing permit <br />File X78-252. Previously developed vegetation <br />information is also presented in the same permit <br />under Exhibit J. <br />11. If the statement that no rare and endangered <br />species of plants are found within the permit area <br />was not made in the text of the permit application, <br />it will be added. <br />Section 2.04.11 Fish and Wildlife Information <br />A response from the Division of Wildlife concerning <br />the Peregrine falcons was provided to Chimney Rock <br />Coal shortly before the permit applications was <br />submitted. However, it was not received in time <br />for insertion into the text. The response will be <br />inserted into the final revision. The main concern <br />is that above ground blasting does not occur <br />during the nesting, brooding and fledging periods. <br />I explained to Mr. Norwin Smith that all blasting <br />at the Chimney Rock mine occurs below surface <br />grade, therefore, above ground blasting would not <br />be a problem. <br /> <br />
