6. Due to the change in the post mining land use
baseline information which describes the pinyon
community is not needed. This was agreed upon
during our discussion on the above referenced
date.
Transect lines which depict the areas where
vegetation sampling occured will be added to the
vegetation map. The riparian community located
along Stollsteimer Creek will also be added to the
same map.
Refer to the attachment provided herewith for a
discussion of the concerns provided in this part
of the P.A.R.
9. As we discussed in your office on the above
referenced date, vegetation sampling was conducted
based upon guidance received from the Division as
well as the requirements defined in the regulations.
An attachment hereto is provided which presents a
response to this concern.
10. The previously developed vegetation map referenced
in the permit is a portion of the existing permit
File X78-252. Previously developed vegetation
information is also presented in the same permit
under Exhibit J.
11. If the statement that no rare and endangered
species of plants are found within the permit area
was not made in the text of the permit application,
it will be added.
Section 2.04.11 Fish and Wildlife Information
A response from the Division of Wildlife concerning
the Peregrine falcons was provided to Chimney Rock
Coal shortly before the permit applications was
submitted. However, it was not received in time
for insertion into the text. The response will be
inserted into the final revision. The main concern
is that above ground blasting does not occur
during the nesting, brooding and fledging periods.
I explained to Mr. Norwin Smith that all blasting
at the Chimney Rock mine occurs below surface
grade, therefore, above ground blasting would not
be a problem.
