The Code of Federal Regulations, <br />Title 30, Part 77.216, Sub-parts (a)(1,2, and 3) state specifically that <br />plans must be sutanitted if the structure and/or impoundment is at least <br />20 feet high, more than 5 feet high and impounds more than 20 acre-feet, <br />or is a hazard. <br />Mr. Steve Miller, Coal Mine Safety and Health, District 9, Impoundment <br />Specialist, believes that the site will not pose a hazarri and concurs <br />that a plan suiznittal is not warranted considering facility size in con- <br />junction with CFR 77.216. As such, it is the authors opinion that design <br />drawings and supporting technical documentation is not necessary. <br />Sincerely, j <br />ephen W.
