The Division is proposing to approve the <br />application with stipulations. Please review the document, note any <br />corrections you feel are necessary. Any corrections will have to be done at <br />the beginning of next week. Because of the tight time frames, the Division <br />will not review any new information prior to the publication date. <br />The bond amount proposed by the CYCC is acceptable except that the Division is <br />not recommending approval for the permanent impoundments and, therefore, the <br />Energy No. 3 Pond and Middle Creek Pond will have to be reclaimed. Since CYCC <br />was proposing to leave the ponds as permanent structures no reclamation costa <br />were provided in the permit application. Reclamation costs for these <br />structures were calculated by the Division to be $29,000.00 as shown on the <br />attached memo. The bond will need to reflect the additional costa. Total <br />reclamation coats come to $3,732,700.00. An acceptable bond in the amount of <br />$3,732,700.00 must be posted with the Division before the new permit will be <br />iseu~--' <br />This decision document ie considered the Division's initial administrative <br />decision. Pursuant to Rule 2.01.3(2)(b), once an initial administrative <br />decision has been rendered the old permit is no longer valid and operations <br />must be conducted in compliance with the new permit. <br />Thank you for your cooperation in this process.
