Therefore, please provide a statement
that demonstrates that these new roads and culverts can
support the approved postmine land use. Also, please provide
the necessary landowner consents, if applicable, for retention
of these structures.
2.05.6 MITIGATION OF THE IMPACTS OF MINING OPERATIONS
On page 2.05-72 of the permit application, it is stated that
the sediment ponds will be sampled in compliance with NPDES
permit requirements. No mention is made of performing a full
suite analysis of each pond's discharge. The operator will
need such data in order to assess the probable hydrologic
impacts of mining on the environment, as required in Rule
2.05.6(3)(b)(iii). Therefore, pursuant to Rule
2.05.6(3)(b)(iv)(D), the Division would like the operator to
commit to performing an annual full suite water quality
analysis for each pond's discharge. Such a commitment would
include the date for sampling and a reference to the list of
constituents shown on page 2.05-77 of the permit application
as those constituents that will be sampled.
C:\WP51\80W2ADEQ.2
M:\COAL\AJW\BOW2ADEQ.2
