Rule 2.03.6 - Right of Entry: The applicant states on page 3-6 of the <br />/ application that "A copy of a letter from the South Durango Water <br />District granting right of entry over their land within the permit area <br />is in Appendix 3-2." It appears that as the permit area has changed, <br />this statement may need revising. Please address. <br />f23. Rule 2.03.8 - Permit Term: The applicant has responded to requirements of <br />describing proposed and anticipated operations with a description of <br />Pueblo Coal's previous operations, but stated it as though the applicant <br />~~ (OEI) did the work. This is misleading, as this application is for a new <br />~(.. permit, not for a renewal of Pueblo Coal's permit. Please address. <br />6 Applicant states "Starting and completion dates for the various phrases <br />of the operation have been set forth in the Mine Plan section." These <br />"~ specific dates were not found in the Mine Plan Section. Please address. <br />la. Rule 2.03.8(2) requires a description of operation dates for underground <br />mining activities. Applicant inappropriately responded to this question, <br />as this application is for surface mining only. Please revise. <br />_25. Rule 2.03.9(1) states "prior to issuance, each applicant shall submit a <br />~,-,~ certificate of insurance.." The applicant has stated that OEI maintains <br />~ insurance in an amount no less than specified by this section, as shown <br />in Appendix 3-3". A check of the insurance policy indicates it expired <br />on 12/5/92. The policy does not identify the Carbon Junction Mine <br />specifically, nor does it appear to contain the rider required by <br />2.03.9(3). Please address. <br />26. Rule 2.03.10 requires the applicant to list other permits needed for <br />operation. A check of Appendix 3-4 found the following: <br />oP ~'sy(a) CPDS permit #COG 85000 has been issued to Pueblo Coal, Inc. This plan does not appear to be on the <br />permit. Please address. <br />The CPDS permit pages are out of order. Please correct. <br />Air Permits and Local Permits have been issued to Pueblo Coal, and <br />are over 10 years old.
