RE: Graft Findings for Seneca II-W Mine -File No. C-057-82
Dear Mr. Wainwright:
Enclosed is a copy of the "Proposed Decision and Findings of Compliance for
the Seneca II-W Mine." The Division is proposing to approve the application
with stipulation.
Pursuant to Rule 2.07.4 (2) (d), the proposed decision must be published in a
newspaper local to the operation once a week for two weeks. If no request for
a formal hearing is received within the 30-day public comment period after the
first publication, the Division's decision will become final.
Peabody may file the required performance bond of $2,646,300.00 anytime after
the proposed or final decision. However, the permit cannot be issued and
mining cannot commence until the bond has been submitted and approved.
