Is a permit required to "monitor" eagle nests? <br />As you descri.~e "monitor" in prefacing this question ,the answer is <br />no, a permit is r.ot required. If, however, "monitoring" includes visiting <br />the nest at any cline the nesting pair of eagles, eggs or hatchlings are <br />present, then a permit is required as such a visit t•rould undoubtedly <br />"disturb or molest" the eagles to some degree. ";tisturb and molest" are <br />included in the definition of "take." under Gald Eagle Protection Act <br />regulations (C0 CFR 22.31 and a permit is required to take eag es (50 <br />CFR 22.12). <br />2. The essence of the first part of your second question as: Does <br />a private coal comttany need a FIJS permit wften mining on privatQ or public <br />lands and yolder~ eagle nests are lucaCed in i.iie yenerai vicini~,p? <br />The answer here is probably yes--depending upon the actua <br />disturbanva the mining actisity causes the nestimi eagles. huh <br />private coal company or the CLPi has any doubt whether ur not a <br />engaged in or sanctioned t,y either would be in pot~_ntial confl <br />Bald Eagle Protection Act, the Fish and Iiildlife Service shout <br />or an application filed for a permit.
