<br />SMALL OPERATORS ASSISTANCE PROGRAM <br />STATEMENT OF AGREEMENT <br />I. The undersigned, as duly authorized representative of the applicant <br />hereby agrees that the applicant will: <br />1. Cooperate fully with all contracted and subcontracted laboratories <br />that will produce the determination and statement; <br />2. Submit coal production information for the area affected by this <br />application and for any other mining area in which the applicant <br />has an interest (as defined in Section B, item 3 of this applica- <br />tion), said information to be furnished within thirty (30) days <br />of the end of the first twelve (12) months of mining activity and <br />thereafter for each twelve (12) month period for the life of this <br />application; and, <br />3. Refund in full the Division of Mined Land Reclamation (hereinafter <br />called the Division) for laboratory services paid far by that agency <br />pursuant to this application, upon presentation of appropriate <br />receipts, if any of the following conditions occur: <br />a. Information submitted as required by paragraph (1) above <br />shows coal production to be in excess of 100,000 tons in <br />a twelve month period; <br />b. No information or false information is submitted; <br />c. No permit application is submitted within one (1) year <br />from the date of receipt of the approved laboratory <br />report; <br />d. The permit application for any valid reason, is denied <br />by the Division; <br />e. The applicant fails to commence mining after obtaining <br />a permit. <br />II. The undersigned, as duly authorized representative of the applicant, <br />hereby affirms that the applicant (including affiliated companies, as <br />specified in Section B, item 3 of this application} has produced no <br />more than 100,000 tons of coal in the twelve (12) months preceding <br />submission of this application for assistance. <br />III. The undersigned, as duly authorized representative of the applicant, <br />hereby acknowledges that submission of the data provided through this <br />assistance as part of the permit application does not constitute <br />unconditional or prior approval of any permit appcation containing <br />said data. <br />
