ADDENDUM TO COAL MINING LEASE
This Addendum dated this „ day of November, 1981, by and
between LOUIS J. GIULIANO, IRENE GIULIANO and DIANA G. BOLESKI,
co-partners, doing business under the name and style of GIULIANO
b SONS COAL COMPANY, parties of the First Part, hereinafter re-
ferred to as Lessors, and JOSEPH CARFINE and BUDGIE FAZZINO, doing
business under the name and style of TWIN PINES COAL COMPANY, parties
of the Second Part, hereinafter referred to as Lessee;
WHEREAS, the parties hereto executed a Coal Mining Lease dated
October 1, 1977, in which the leased premises are described as set
forth therein; and
WHEREAS, the parties hereto wish to amend the legal descrip-
tion of said leased premises as hereinafter set forth.
NOW THEREFORE, IN CONSIDERATION OF THE MUTUAL PREMISES HEREIN
IT IS AGREED .AS FOLLOWS:
1. The legal description for the premises herein leased
shall be amern9ed to read as follows, to-wit:
The Brookside Coal Seam only and all clay deposits
ins~~far as the same underlie the following described
premises situate in the County of Fremont, and State
of Colorado, to-wit:
TOWNSHIP 20 SOUTH, RANGE 70 WEST OF THE 6TH P.M.
Section 1: W;
Section 2: All
TOWNSHIP 19 SOUTH, RANGE 70 WEST OF THE 6TH P.M.
Section 35: S?
Subject to certain clay rights granted to P4ARY ALVIDREZ,
RICFIARD ALVIDREZ and CASIMIRO ALVIDREZ, JR., by Lease
Agreement dated May 17, 1981, by and between GIULIANO
AND SONS COAL COh1PANY, as Lessor, and I1ARY ALVIDREZ,
RICFIARD ALVIDREZ and CASIMIRO ALVIDREZ, JR., as Lessee.
2. All other conditions, provisions and covenants of
said Coal Mining Lease dated October 1, 1977, and Addenda thereto,
are hereby ratified and confirmed between the parties hereto.
