<br />Draft FindinQS for Colorado Coal Resources Permit <br />XII Vegetation <br />Grazine Plan <br />As stated in the permit application, grazing will not occur on the <br />reclaimed mine area until the last two years of the liability period. <br />Fences will be incorporated to prevent livestock from entering those <br />areas that have been reseeded. This will allow for an adequate period of <br />vegetation establishment. Two years before the end of the liability <br />period, livestock will be allowed to utilize the area for grazing. The <br />grazing rates to be allowed have not been determined at this time and <br />will have to be calculated based on the condition of the reclaimed area <br />immediately prior to commencement of grazing. The rates will be based <br />on AUM's as defined by the U.S. Soii Conservation Service and will be <br />derived from the quantity of available forage estimated from interim <br />vegetation surveys. <br />XIIZ Fish and Wildlife <br />Chimney Rock Coal will make every reasonable effort to work with the <br />Colorado Division of Wildlife to insure that no negative impacts will <br />occur as a result of mining activities. <br />XVIII Coal Processing Waste and Non-Coal Processing Waste <br />Chimney Rock Coal agrees that, before construction of a coal processing <br />plant, a revision to this permit application will be submitted to the <br />Division fox approval. The need for a facility of this type is presently <br />not anticipated. <br />1 <br />
