y <br />~' <br />Ground Water Rights <br />Colorado ground water law is complex and still develop- <br />ing. At present, ground water is divided into two <br />categories under which ~it can be appropriated, non- <br />tributary and tributary. There are many exceptions to <br />this general statement, but they do not apply here. <br />Non-tributary water is essentially ground water that <br />does not interface with the surface water system and <br />tributary water does. Appropriation of non-tributary <br />ground water is governed by the volume of water <br />available from the aquifer under the property <br />owned/controlled by the claimant. Tributary water is <br />governed by the same rules. and regulations as surface <br />water. In both cases, it must be shown that new <br />appropriations will not affect or injure other water <br />users. <br />~~ - 3 <br />
