<br />-2- <br />A chronology of events is found in Attachment B denoting dates and descrip- <br />tions of pertinent events regarding the Ohio Creek dine '12. Ohio Creek's min- <br />ing plan was reviewed by OSM under [he Colorado State Program and the Federal <br />Lands program (30 CFR Chapter VII, Subchapter D). The Mineral Leasing Ac[ <br />portion of the it RP was also reviewed far compliance with the applicable por- <br />tions of 30 CFR Part 211 (i.e., requirements and responsibilities of the <br />Geological Survey under the :4ineral Leasing Act). The C:tLRD and OS11 developed <br />the stipulations which must be accepted by the applicant prior [o issuance of <br />a permit. These stipulations are hereby made an integral part of the Ohio <br />Creek mining and reclamation plan. <br />The Geological Survey provided written concurrence with the proposed action on <br />February 10, 1981. The Bureau of Land ttanagement provided written concurrence <br />on January 30th and September 14, 1981. The U.S. Fish and Wildlife Service <br />was consulted regarding threatened and endangered species and provided opin- <br />ions in their July 6, 1979 and October 9, 1981 letters. The State Historic <br />Preservation Officer concurred with OSM's proposed compliance with 36 CFR Part <br />80 on August 1, 1981. The State regulatory authority provided a recommenda- <br />tion for approval on August 14, 1981. A copy of each letter of concurrence in <br />our files is attached in Attachment C. <br />The TEA, other documents prepared by C:1LRD, the company's application, and <br />correspondence developed during the completeness review and technical and <br />environmental analysis are part of the mining and reclamation plan file. <br />The Notice of Complete ;line Plan vas published by the State of Colorado Sn the <br />Gunnison County Times in four consecutive weekly insertions from February 12 <br />to Ptarch 5, 1981 in coordination with OSM. At that time, OSM was permitting <br />the state to publish the notices in order to streamline the procedure and <br />reduce redundancy (see attachment F). The combined Votice of Proposed Deci- <br />sion and the Availibility of an Environmental Assessment was published in the <br />same newspaper on December 15, 1981 by the State in coordination with 05:1. <br />There was a thirty day cor®ent period that ended January 15, 1982. Yo com- <br />ments were received (see attachment E). <br />'ly recommendation is based on the complete mining and reclamation plan Ei1z. <br />As attested to in that document, I have determined that this action will not <br />have a significant impact on the human environment. This nine, and [he signi- <br />ficant effects of the proposed mining and reclamation operations, have been <br />addressed in the De partnent's Environmental Impact Statement entitled IJes[- <br />Central Colorado Coal Environmental Statement, issued in February 1979. <br />Based on this review, and as reflectzd in the attached recommendation pacYa;e, <br />recommend that .:ou find chat 4enry L. and Opal Weaver's application affirma- <br />tively demonstrates that Che conditions outlined in the Findings (Attachment <br />D) have been complied with and that you recommend approval for the Ohio Creek <br />Ctine X12 minim and reclamation plan. <br />Attachments <br />cc: Colorado :tined land 2eciamation Division <br />~~.
