Bennett Young <br />Office of Surface !dining <br />Brooks Towers <br />1020 15th Street <br />Denver, Colorado 80202 <br />RE: Ohio Creek ldi ne f1o. 2 <br />Our File No. C-002-80 <br />pear Mr. Bennett: <br />0 <br />?. <br />As eve discussed in our telephone conversation on Julu 22, 1982, the !dined <br />Land Reclamation Division is currently working with Henry weaver to get <br />an acceptable bond on the Ohio Creek .VO. 2 .Nine. ~~tr. weaver has been <br />( having some difficulties securing a corporate surety. The companies contacted <br />to date have responded that the bond is excessive and will not issue a bond <br />in the amount of $26,000. <br />f•1r. Weaver has agreed to bond the operation with a deed of trust on the <br />tipple. This will take a period of several weeks since the building has <br />to be assessed then the necessary papers drawn up. <br />Normally, the Division would issue a cessation order since bonding is presently <br />insufficient. However, given the complexity of the situation and considering <br />that P/r. Weaver has been diligently oursuing a resolution, the Division has <br />been willing to cooperate with him. <br />The cooperation of the Office of Surface Mining with the :tined Land Reclamation <br />Division on this matter will be greatly appreciated.
