Deut. of ^!a;ur21 f'esc^rces <br />Re: Coal Mine Permit Application No. 77-353 <br />Additional Information for Exhibit 0 - Legal Right to Enter <br />Dear Mr. Massey: <br />As you know, Colorado Westmoreland has been awaiting the <br />issuance of a federal lease which would enable it to continue <br />its mining operation. Several of the areas which we included <br />in our application to the Mined Land Reclamation Board were <br />the subject of right-of-way applications to the Bureau of Land <br />Management. Unfortunately, these right-of-way applications <br />were tied up with the lease issuance pending environmental <br />review. On March 21, 1978, a coal lease was issued to Colorado <br />Westmoreland and at the same time the rights-of-way and a <br />temporary use permit were issued by the Bureau of Land Management. <br />The right-of-way which was issued (~~C-25150) covers the <br />diversion ditch, the sediment retention dams, and the water line. <br />A temporary use permit (CO-030-TU-78-6) covers the area which <br />will contain the refuse disposal site. <br />Issuance of this right-of-way and temporary use permit <br />should complete our application regarding the legal right to <br />enter.
