Hagen: <br />Enclosed 1s a copy of the revision you requested. In addition, there are <br />three points 1n your letter I want to bring to your attention. <br />First, 1n the first and second paragraphs, you state that a violation existed <br />at the mine site. This 1s an allegation that was never proven. A Notice of <br />Violation was never written by either NLRD or OSN. The State did not believe <br />a violation existed. The statement is incorrect because the alleged violation <br />was never substantiated. <br />Second, the third paragraph discusses continued inspection of the site by OSN. <br />This appears to go beyond the OSN oversight sampling policy. Since neither a <br />TDN or an NOV are at issue, this mine does not appear to be a special case. <br />There are a number of mines in Colorado which are undertaking reclamation work <br />in a timely manner. Is the regular Inspection of Sundance Coal a precurser of <br />a new OSN oversight policy for the Mest? Should we expect other mines to <br />undergo regular inspection by OSN beyond the one inspection per year, 1n the <br />future? An explanation of the third paragraph is needed and will be <br />appreciated. <br />The third point is that 1t appears that the resolution to this Issue was <br />largely due to the point inspection. If that 1s so, then I want to Increase <br />our efforts to conduct ,point inspections.
