Additionally, we have contacted representatives of Sheridan Enterprises,
Inc. to discuss these concerns. The following discussion is the Division's
response to your concerns;
1. Sheridan Enterprises, Inc. has submitted a receipt to the Division
indicating that their application was received by the Mesa County Recorder
on February 20, 1981. Sheridan also stated that they recently visited the
Mesa County Clerks office and found the application on file there. S also
contacted the Mesa County Clerks office by telephone on August 11, 1982 at
which time they informed me that the application was in fact on file there.
2. During review of applications for permit approval the Division's
concern .is that- all local and county approvals have been obtained and are
in force at the time of permit issuance. Renewal and maintenance of any
agreements are the responsibility of the applicant and the local planning
or regulating authority.
3. Resolution No. MCM 82-190 does limit Sheridan Enterprises, Inc.
to the storage of not more than 2,000 tons of coal at the IAma loadout
site. Representatives of Sheridan Enterprises, Inc. have been advised
that this fact must be reflected in their permit application and the Division
wilt state this in the Final Decision package. It is also my understanding
that Sheridan can be granted specific approval from the Mesa County
Commissioners for greater storage on an interim basis.
