_., <br />5. At the October 23, 1986 formal hearing representative's of Mt. Harris <br />Coal stated that it did not need a permit since the processing and <br />tippling facility was not operating. In addition, Mt. Harris stated <br />that it did not have the resources to post the required 510,000.00 bond, <br />therefore, it could not accept the permit. <br />6. The Board finds that the Division's proposed decision to approve the <br />permit application is appropriate. <br />Decision <br />Upon formal motion and by unanimous note, the Board hereby affirms the <br />Division's proposed decision to issue a mining and reclamation permit 'to Mt. <br />Harris Coal Company. <br />The Board's decision is based on a finding that the Division and the applicant <br />have complied with all of the applicable requirements of the Colorado Surface <br />Coal Mining Act, C.R.S., 34-33-101 et seq, and the rules promulgated <br />thereunder. <br />Dated and effective this ~~ day of ~, 1986. <br />(tAined Land Reclamation Board) <br />~G~~V <br />Dickey Lee H inghurst, Chair son <br />/vj r <br />4745E <br />
