Shelton <br />Director <br />Jvly 5, .i.98.1 <br />Re: Sediment Control Plan for the Northgate Load-out <br />Dear Scott: <br />I would like to respond to your June 23, 1981 letter regazdir)y plrurs for <br />sediment control for the Northgate Load-out facility. <br />The Division cannot waive the water qual~:ty standards and effluent ;• <br />limitations as outlined in 4.05.2. The ))ivision can grant exem~~i:ions <br />from tt~ requirement to pass all suzfacc.• drainage through a sedimentation <br />pond (or ponds), or a water treatment far-ility, In order for the Division <br />to grant such an exemption, the applicant:/operator must demonstrate one <br />of the following (in addition to the determination that the area is sma1Z <br />in extent): <br />A. Sedimentation ponds and/or treatment facilities are not necessary <br />for drainage to meet the effluent limitations of 4.05.2. <br />B. No surface runoff occurs in the area for which the exemption has <br />been requested. <br />C. It is impractical to construct a sedimentation pond due. to constraint's <br />• relative tb size of the affected area. <br />If the Division grants a small area exemption to an applicant and subsequent <br />field examinations indicate that the limitations of 4.05.2 are Trot' being <br />met, the operator must agree to install a conventional sedimentation control <br />system. <br />Upon close examination of the depression existing on site which lras been <br />proposed as a sedimentation basin, the staff has determined that stz•ucture <br />is unacceptable since the depression i:: largely filled with tar, <br />Even though the Cumberland Ditch has been abandoned, the staff needs to <br />know whether anyone has water rights to the water which would flow through <br />the ditch, and whether the Ian downer or lessee plans to utilize it in the <br />future. <br /> <br />
