Box 55 <br />Oak Creek, Colorado 80467 <br />Re: Apex No. 2 Permit Application, Completeness Finding <br />Our File No. C-011-81 <br />Dear Dave: <br />Enclosed is the Notification of Completeness for the Apex No. 2 <br />permit application. I Taant to advise you that the proposed <br />newspaper publication included in the application will not satisfy <br />the requirements of CRS, 1973, 34-33-110(1)(8) and Rule 2.07.3 <br />(2); using the suggested format we discussed today on the phone <br />should satisfy all requirements. <br />In reviewing your application for "completeness", I was atiaare <br />that no materials have been separated from the main body of the <br />text and marked as confidential. This consistent with our dis- <br />cussion on February 4, 1981, when you delivered the application <br />to us and indicated that you did not feel it necessary to restrict <br />public access to any portions of your application. I noticed at <br />least one map or cross-section in your application that had been <br />marked confidential prior to reproduction and it would therefore <br />seem appropriate to ask you to clarify this situation on paper. <br />In addition to the requirements of Rule 2.07.5(2)(a), the Division <br />is requesting a listing of all items an operator feels must be <br />held in confidence and a justification for such restriction from <br />public access to be used by the Division in the event that the <br />propriety of maintaining the requested confidentiality is questioned. <br />This request does not affect the completeness finding but we are <br />urging all operators to provide this information as soon as possible. <br />If you have any questions regarding these or other matters, please <br />feel free to contact me.
