Re: Modifications of Permit No. 79-177
Dear Mr. Damra u:
The Division has received the modifications to Permit 79-177 as required by
Rule 2.01.3(5) of the regulations promulgated pursuant to C.R.S. 39-33-101,
et. sue. Colorado Yampa Coal Company (CYCC) has submitted information to
reflect the substantive differences between the approved Colorado regula-
tory program and the permanent Federal regulatory program for the following
sections of the Colorado program:
1. Alternative FJater Supply Information, Rule 2.04.7(3)
2. Vegetation Information, Rule 2.04.10
3. Revegetation: Standards foz Success, Rule 4.15.7(3)(b)
9. Revegetation: Success Criteria, Rule 4.15.8
5. Roads (haul roads, access roads, light-use roads), Rule 9.03
For the purpose of filing on this date, your application, per Rule 2.01.3(5),
has been deemed complete.
Simultaneous with the requirements of Rule 2.01.3(5), CYCC must address the
requirements of Rule 2.08.6, Transfer, Assignment or Sale of Permit Rights,
since CYCC is succeeding Energy Fuels Corporation as the permittee. Specifically,
CYCC must obtain the performance bond coverage of Permit 79-177 and provide the
information required in Rules 2.03.4, 2.03.5, 2,03.6, 2.03.7(3), 2.03.9 and
2.03.10. The Division is required, per Rule 2.08.6(4), to make a written
finding based on this material.
The newspaper advertisement submitted with the application has been found to be
satisfactory. Upon receipt of this letter, you should commence publication of
this advertisement as specified in Rule 2.07.3(2) and 2.08.6(3) of the Regu-
lations. Proof of the publication of the advertisement must be filed with the
Division not later than four weeks after the last publication date.
