i=•~ -_ <br />ATTACHMENT <br />Permit Condition <br />If previously unidentified cultural properties are discovered during the course of <br />mining operations, the applicant shall ensure that they will not be disturbed and <br />shall immediately notify the regulatory authority. The operator shall ensure that <br />the site or sites are properly evaluated for National Register Eligibility <br />(36 CFR 60.6). Should a property or properties be found eligible for listing in <br />consolation with the regulatory authority, the land managing agency (if the site <br />is located on Federal lands), and the State Historic Preservation Officer, the <br />operator shall obtain their approval of a mitigation plan if the site will be <br />disturbed or destroyed. <br />Stipulation <br />In the event that subsidence reaches the surface and becomes a potential impact <br />to the cultural resource base, further archeological inventory may be required. <br />Determination of the need, amount and intensity of the survey will be made by OSM <br />in consultation with the State Historic Preservation Office and State Regulatory <br />Authority. <br /> <br /> <br />•L <br />5 Y. <br /> <br />
