<br />and peaceably deliver to Lessor the abovadacribed premises, and such premises shall be in good mining condition. If, upon termination of <br />this lease for any reason, whether by surrcrdv, forfeiture or expiration of term or otherwise, Lessee shall not have fully complied with the <br />terms of the lease, Lessor shall hold atd retain possession of the property, improvements, and equipment of Lessee as sxuriry unto Lessor for <br />the payment of rents and royalties due it, or to protect it against liens, or to indemnify is ageinu any loss or damage susuircd by it by reason <br />of the default of Lessee, for which purpose lessor is hereby given a lien upon all such property, improvements, and equipment, which lien shall <br />attach as the same arc plead upon the premises. In the event Lessor shall foreclose the lien in this enicle given to it by Lessee, Lessor may itself <br />be a purchaser rn any sale thereof wrier such foreclosure. Upon the termination of this lease (or any cause, if Lessee shall remain in possession <br />of said premises, he shall be gu0ry~of en unlawful drainer order the statutes in such case nude and provided, and he shall be subject to all the <br />corditiont and provision thereof and to evinion and removal, forcibly or otherwise, with or without proceu of law, as above provided. <br />30. CONDEMNATION - If the leased lard shall be liken in any condemnation proceeding, this lease shall sutomatirslly terminate es of the daro <br />of taking. The award for such condertwdon shall be paid to Lessor, except for any specific award(s) paid to Lessee for severed coal reserves, <br />in which even a percent of such specific award(s) equal to royalty shall be paid to Lessor in lieu of royalty lost by virtue of the condemnation. <br />Improvements shall be removed by Lessee per tertro in the RIGHT OF REMOVAL paragraph herein. If only a ponion of the leased land is <br />taken by condertwtion, Lessor rtuy, at its option, terminate this lease or terminate only that portion of the lease so liken. <br />31. The bercfiu, terms, and obligations of this lease shall extend to and be binding upon the heirs, executors, administrators, successors, or assigns <br />of the respective Iwriet hereto. <br />12.
