Box 511 <br />Aguilar, Colorado 81020 <br />Re: Stipulation Responses, Ftle No. C-031-B1 <br />Dear Mr. Wilson: <br />The Division has completed its review of responses submitted by American <br />Fuels, Inc. and J.F. Sato and Associates for permit stipulations No. 1 <br />through 14. With the imposition of a feu conditions the Division can <br />determine that all these stipulations have been satisfied. The <br />conditions are as follows: <br />1. A reclamation plan and bonding calculations are to be submitted for <br />sediment pond Z, the new section of haul road, and the coal handling <br />facilities. <br />2. The red dog material from the old refuse pile can be used as <br />surfacing material for the new section of the haul road. The remaining <br />material in the pile 1s to be disposed of in the middle, vertically, of <br />the backftlled pit. It 1s not to be placed in the bottom of the pit in <br />order to minimize any impacts to ground water. It is also not to be <br />placed at the top of the pit since tt would inhibit plant reestablishment <br />on reclaimed areas. Placement of the refuse material to the middle of <br />the pit should minimize both of these potential impacts. <br />3. Sixteen inches of freeboard should be installed above the haul road <br />culvertdralntng an area 3.5 acres in size. <br />You Indicated during our telephone conversation today that these <br />conditions were reasonable and acceptable. Therefore you are able to <br />commence any and all permitted surface mining operations at your w111, <br />unencumbered by stipulation restrictions. The stipulation responses now <br />become a binding part of the mining permit. Additional responses are due <br />by the end of the month on stipulation No. 15.
