FISH <br />AND IILDLIFE MITIGATION, PRIME FARMLAND INVESTIGATION <br />These represent my "first-cut" concerns on the above sections in the Snowmass <br />application. P4any of these concerns must be addressed before I can proceed any <br />further in my analysis. <br />Postmining Land Use 4.16 <br />1. Snowmass must state that the land will be restored in a timely manner to <br />conditions that are capable of su ortin the uses which the were ca able of <br />supporting before any mining or to achieve better or higher uses 4.16.1 or <br />apply to the Division for a finding to change the P.M.L.U. <br />2. Any change in P.M.L.U. during the life of the mine must be approved by <br />tfle Division in consultation with the landowner or land management agency <br />having jurisdiction upon the meeting of the criteria in 4.16.3. <br />3. Snowmass must justify the retaining of roads in their P.M.L.U. plan. These <br />roads must be mapped relative to the final reclamation surface and must meet <br />applicable performance standards. <br />Fish and 41i1d]ife Resources Information 2.04.11 <br />1. Snowmass needs to document contacts with this Division which determined the <br />resources information needed (2.04.11(2)). <br />2. Snowmass should contact the Colorado Division of lildlife, and appropriate <br />Federal agencies to determine the relevant Fish and Wildlife information. <br />3. Snowmass needs to document any critical wildlife habitat or habi±at of <br />unusually high value at the mine or loadout sites. <br />4. Snowmass needs to provide a species list of the wildlife encountered or <br />potentially encountered in the areas of the mine and loadout. This list should <br />include the classes: mammals, birds, reptiles, amphibians, and fish. A list <br />of the major riparian organism inhabiting streams near the mine and loadout <br />should be included (sampling locations should be mapped). <br />5. Snowmass needs to determine whether any rare, threatened or endangered species <br />is present in the permit area. <br />J <br />
