Dept. of Natural Resource <br />Dear Fred: <br />This letter outlines the permitting process since Powderhorn Coal Company <br />received the draft proposed decision document dated March 19, 1982. This <br />document stated, "At this time a decision to either approve or deny the per- <br />mit application has not been made. The final decision will depend on <br />whether the issues identified in this document are resolved in a timely <br />manner." After referring to the draft proposed decision document and re- <br />viewing the attached chronology, I'm sure you'll agree that Powderhorn <br />Coal Company has been diligent and dedicated to compiling all the infor- <br />mation required and addressing all concerns set forth in a minimum period <br />of time. <br />Since receiving the draft decision document we have addressed all defi- <br />ciencies and stipulations expressed by the Division, or we have proposed <br />reasonable plans to address concerns related to future activities. In <br />addition, we have implemented plans in advance of publication of the pro- <br />posed decision to relieve certain concerns and eliminate stipulations. A <br />response to each item of concern was transmitted to the Division as soon <br />as it was developed to allow input during this process from those re- <br />viewing the responses and to subsequently hasten the approval process. <br />Again, these actions demonstrate diligence by Powderhorn Coal Company. <br />The formal response to the draft decision document was submitted to the <br />Division on August 11, 1982. This submittal was a comprehensive re- <br />sponse and included all the information previously submitted to or dis- <br />cussed with the Division. As we expressed in our meeting on September 1, <br />1982, Powderhorn Coal Company has diligently submitted all information <br />needed by the Division to make the required findings and publish the pro- <br />posed decision. <br />POWDERHORN COAL COMPANY • P.O.
