<br />' SPECIAL <br />' ~ WARRANTY DEED <br />(A Colorado Statutory Short Form) <br />CAh1E0 LAND COMPANY, a Colorado corporation, "Grantor", <br />in consideration of Ten Dollars ($10.00) in hand paid and <br />other good and valuable considerations, the adequacy of <br />which is confessed and acknowledged by Grantor, sells, <br />conveys and transfers to POWDERHORN PROPERTIES COMPANY, a <br />Colorado General Partnership, "Grantee", the following <br />described real property and other interests, all of which <br />are located in Mesa County, Colorado: <br />Township 10 South, Range 98 lJe sC, 6th P.M. <br />Section 26: All that part of the SWkNW} and of <br />the W§ SW's lying on the West side of the Colorado <br />River. <br />Together with all improvements and appurtenances, <br />located upon or used in connection with the property <br />conveyed by this instrument and all of the Grantor's <br />interest in any ditches, ditch rights, water and <br />water rights used on or in connection with the <br />property interests conveyed by this Snstrument, <br />also cogether with all rights of ingress and <br />egress to the property conveyed by this instrument <br />owned or held by Grantor and all other rights <br />owned or held by Grantor and used on or in connection <br />with the property interests conveyed by this <br />ins [rumen[. <br />Grantor warrants the title to the real property interest <br />conveyed by this instrument against all persons claiming under <br />it subject to the following: <br />1. The 1982 and subsequent taxes levied and assessed <br />against the real property interests conveyed by this instrument. <br />2. The reservation of all coal in and under the <br />SW~NW~ of Section 26, as stated in the instrument recorded <br />in Book 306 at Page 160 of the Mesa County records. <br />3. The exceptions and reservations contained in the <br />patents issued by the United States of America. <br />4. The right of way for a roadway as reserved to <br />Frank Hickman in the instrument recorded in Book 120 at <br />Page 205 of the Mesa County records. <br />5. The easement granted to Public Service Company of <br />Colorado by the instrument recorded in Book 1159 at Page 94 <br />of the Mesa County records. <br /> <br />
